Terms of Service

The terms governing your use of the cura app, this website, and the cura focus service.

These Terms of Service ("Terms") govern your use of the cura app, this website, and the cura focus service, including the cura Block and cura Station (together, the "Service"), provided by cura Technologies GmbH ("cura", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Please also read our Privacy Policy.

1. Who may use cura

You must be old enough to enter into a binding contract and to consent to the processing of your data under the law of your country (the age of digital consent). If you are younger, you may use the Service only with the agreement of a parent or legal guardian, who accepts these Terms on your behalf. By using the Service, you confirm that you meet these requirements.

2. Your account

  • You need an account to use core features. Provide accurate information and keep it current.
  • You are responsible for your login credentials and for activity under your account. Keep your credentials confidential.
  • You may delete your account at any time in the app. We may retain limited data as described in the Privacy Policy or as required by law.

3. Licence to use the app

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the cura app on Apple devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the applicable App Store terms. All rights not expressly granted are reserved.

4. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in breach of these Terms;
  • copy, modify, reverse engineer, decompile, or attempt to extract the source code of the app, except where this restriction is prohibited by law;
  • circumvent, disable, or interfere with the security or operation of the Service;
  • resell, rent, sublicense, or commercially exploit the Service without our prior written consent;
  • use automated means to access the Service or to collect data from it;
  • infringe the rights of others or submit unlawful content.

5. The cura Block and cura Station

The cura Block (a personal NFC tag) and the cura Station (an NFC tag placed at partner locations) let you start and stop focus sessions by tapping your device. Purchase of cura hardware is governed by our separate General Terms and Conditions for the shop. You are responsible for the safekeeping of your tag. If you share a tag, the people you share it with may manage shared sessions and see limited account information, as described in the Privacy Policy.

6. What cura is, and what it is not

cura is a focus aid that helps you limit distracting apps and websites using Apple's Screen Time technology. cura is not a security tool, a parental-control guarantee, or a safety device. We do not guarantee that the Service will block every app or website, work without interruption, or be free of errors, and features such as emergency unblock exist by design. You remain responsible for your device, your data, and your own obligations. Do not rely on cura in situations where a failure to block, or to unblock, could cause harm.

7. Apple Screen Time and the App Store

The app uses Apple's Screen Time and Family Controls frameworks and is distributed through the Apple App Store, subject to Apple's terms. These Terms are concluded between you and cura only, not Apple, and cura alone is responsible for the app and its support. Apple has no obligation to furnish maintenance or support for the app. To the extent Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA") applies, these Terms supplement it; in case of conflict on a matter the Apple Standard EULA governs, the Apple Standard EULA prevails. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a relevant embargo and that you are not on any prohibited-party list.

8. Purchases and subscriptions

The app is currently free to use. We may introduce paid features or subscriptions in the future; any such purchase will be made through the Apple App Store and is subject to Apple's terms and to any additional terms shown to you at the point of purchase. Purchases of physical cura hardware are governed by our separate General Terms and Conditions for the shop.

9. Intellectual property

The Service, including the app, the website, the "cura" name and logo, designs, text, and other content, is owned by cura Technologies GmbH and protected by intellectual-property laws. We grant you only the limited licence set out in these Terms. If you send us feedback or suggestions, we may use them freely and without obligation to you.

10. Third-party services

The Service relies on third parties (for example Apple, and sign-in providers such as Google). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

11. Changes to the Service and these Terms

We may change, suspend, or discontinue parts of the Service. We may also update these Terms; if we make material changes, we will post the updated Terms here with a new effective date and, where appropriate, notify you. Your continued use of the Service after the changes take effect means you accept the updated Terms.

12. Suspension and termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

13. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that it will meet your requirements. Nothing here excludes warranties or rights that cannot be excluded under applicable mandatory law.

14. Limitation of liability

To the fullest extent permitted by law, cura is not liable for indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing in these Terms excludes or limits our liability for intent or gross negligence, for death or personal injury, or any liability that cannot be excluded under applicable mandatory law, including mandatory consumer-protection rights. Where liability cannot be fully excluded, it is limited to the extent permitted by law.

15. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The ordinary courts at the registered seat of cura Technologies GmbH in Zürich have jurisdiction, subject to any mandatory place of jurisdiction. If you are a consumer resident in Switzerland or the EU, you also benefit from the mandatory consumer-protection rules of, and may bring proceedings in the courts of, your country of residence.
